Terms of Service

These Terms govern your use of the website operated at openwallsgallery.comby Open Walls Gallery ("OW", "we", "us"). By browsing, subscribing to the newsletter, or purchasing through the site, you accept these Terms. If you do not accept them, please stop using the site.

1. The site at a glance

openwallsgallery.com is an editorial and curatorial platform documenting contemporary urban art. Some pages feature works available for sale through our shop. Editorial content is provided for information; sales are governed by these Terms together with each artwork’s individual listing.

2. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract in your country of residence to purchase from us. Browsing and newsletter sign-up are open to anyone aged 16+.

3. Orders, prices and payment

Prices are displayed in the currency stated on the artwork page and include applicable VAT where required. Shipping and customs duties are calculated and disclosed at checkout. We may correct manifest pricing errors at any time before shipment by cancelling the affected order and refunding any payment received in full.

Payment is processed by Stripe Payments Europe Ltd (Dublin, Ireland). We never receive or store your full card number. A contract of sale is formed only when we send you a shipment-confirmation email.

4. Shipping

Artworks are shipped from the gallery’s storage facility. Lead times vary by destination and are indicated on the order confirmation. Risk of loss passes to you on delivery. International orders may be subject to customs duties and import VAT that we cannot pre-calculate; these remain payable by you.

5. Right of withdrawal & returns

Consumer buyers in the EU and Switzerland have a 14-day right of withdrawal from the day after delivery, subject to the carve-outs listed in our Returns Policy. Original artworks that have been personalised, or made to order, are not eligible for withdrawal. The full procedure and the carve-outs are in the Returns Policy.

6. Intellectual property

All editorial text, photography, layout, code and trademarks on openwallsgallery.com are protected by copyright and trademark law. The rights to each artwork remain with the respective artist; purchase of a physical work does not transfer reproduction rights. You may share short excerpts for non-commercial editorial purposes with a credit and a link back to the source page. Any other use — including training of machine-learning models on our content — requires our prior written consent.

7. Acceptable use

You agree not to: scrape the site at a rate that degrades service for other visitors; attempt to break authentication, access controls or payment flows; upload malicious content via the contact form; impersonate another person; or use the site for any purpose that is unlawful in your jurisdiction or ours.

8. Disclaimers

Editorial content is curated in good faith but provided “as is”. Catalogues, condition reports and provenance descriptions reflect the gallery’s honest opinion at the time of writing; they are not investment advice. Colours displayed on screen may differ slightly from the physical work; high-resolution images are available on request before purchase.

9. Limitation of liability

To the maximum extent permitted by law, OW’s aggregate liability arising from or related to the site or a sale is limited to the amount you paid for the affected order in the twelve months preceding the claim. Nothing in these Terms limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

10. Governing law and venue

These Terms are governed by Swiss law. Disputes arising from a purchase by a consumer remain subject to the mandatory consumer-protection rules of the buyer’s country of residence within the EU/EEA. The ordinary courts at the gallery’s registered seat have jurisdiction, subject to the same consumer-protection carve-out.

EU consumers may also use the European Commission’s Online Dispute Resolution platform. We are not, however, obliged to participate in ADR.

11. Changes to these Terms

We may update these Terms to reflect changes in the law or in how the site operates. The “Last updated” date at the top of this page reflects the version in force. Material changes affecting existing orders will be communicated to buyers by email.
